Privacy Policy

Actually is a video-first dating app. You answer short audio prompts with 15-second selfie videos, browse other people's videos, and connect with matches. Dating data can be deeply personal, so this policy explains what we collect, how we use and disclose it, how long we keep it, and the choices available to you.

1. Who We Are and Where This Policy Applies

Actually is operated by Actually Mobile Software, LLC, a Montana limited liability company ("Actually," "we," "us," or "our"), located at 3772 Last Best Pl, Missoula, MT 59808. This policy covers the Actually mobile app and its account and sign-in experiences. Actually is initially offered only in the United States.

Location

With your permission, the app reads your device location to determine your general area. Your GPS coordinates are converted on your device into a postal (ZIP) code. We receive and store the ZIP code, not the GPS coordinates, and use it to show a general area and estimate distances between members. Your device's operating system may process location information when providing this permission and service.

Activity and communications

Purchases

If you buy Premium, Apple or Google processes the payment. We do not receive your card or bank-account details. We receive and store purchase receipts, transaction identifiers, product information, and subscription status so we can activate and verify Premium and prevent misuse.

Device and technical information

We do not currently use third-party analytics, advertising, or cross-app tracking SDKs, and we do not track you across other companies' apps or websites. If this changes, we will update this policy and provide any choices required by law before using the new technology.

3. Where Information Comes From

We collect information directly from you, automatically from your device and your use of Actually, from other members when they interact with or report your account, and from service providers such as Apple and Google when they confirm a purchase or subscription status.

The app asks before using the following device features:

You can grant or revoke permissions in device settings. A feature may not work without its related permission.

5. Sensitive Information

Dating profiles and conversations may include sensitive personal information. Religion, political views, ethnicity, sexual orientation, messages, and some lifestyle details can receive special legal protection. Providing optional profile fields is voluntary. We use these details only to provide the profile, matching, safety, and other services you request; we do not use them for targeted advertising or to make unrelated health or other sensitive inferences. Where applicable law requires consent, you consent by choosing to provide the information after receiving the relevant notice. You can withdraw that consent for future processing by removing the information, changing the related preference, or deleting your account.

We do not sell personal information. We do not disclose it for cross-context behavioral or targeted advertising. We may disclose information as follows:

Our service providers may process information only to perform services for us or as otherwise permitted by contract and law. Information is primarily handled in the United States, although a provider may process it from another location subject to its contractual safeguards.

8. How Long We Keep Information

We keep information only for as long as reasonably necessary for the purposes described above:

We may retain deidentified information that cannot reasonably be linked to you. Actual periods may be shorter when information is no longer needed, and a legal obligation or preservation request may require a longer period.

9. Deleting Your Account

You can delete your account from Settings in the app or request deletion by emailing admin@actually.dating. Account deletion removes your profile from the service and begins deletion of your profile information, media, likes, passes, matches, messages, purchase-entitlement records, and sign-in account from active systems, subject to the limited retention described above. Deleting Actually from your device does not delete your account and does not cancel a store-billed subscription.

10. Your Privacy Rights and Choices

Depending on your state, you may have the right to confirm whether we process your personal information; access, correct, delete, or obtain a portable copy of it; withdraw consent; appeal our denial of a request; and opt out of certain sales, targeted advertising, or profiling. We do not sell personal information or use it for targeted advertising, so there is no sale or targeted-advertising opt-out needed for our current practices.

You can edit many details in the app, manage permissions and notifications in device settings, and delete your account in Settings. For any other request, email admin@actually.dating and describe the right you want to exercise. You may appeal a denied request by replying to our decision and writing "Privacy Appeal" in the subject line. Where allowed, an authorized agent may submit a request for you, but we may require proof of authority and verification directly from you. We may request information reasonably needed to verify your identity and protect your account. We will not discriminate against you for exercising a privacy right.

California residents: we do not sell or share personal information as those terms are defined by California law, and we use sensitive personal information only for the limited purposes described in this policy. Washington and Nevada residents: please see our Consumer Health Data Privacy Notice for additional information and rights.

11. Age Requirement

Actually is only for adults 18 and older. We do not knowingly allow anyone under 18 to create an account or knowingly collect personal information from anyone under 18. If we learn that an account belongs to someone under 18, we will remove it.

12. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect your information, including encryption in transit and access controls. No transmission or storage method is completely secure, and we cannot guarantee absolute security.

13. Changes to This Policy

We may update this policy as the service or law changes. If a change is material, we will update the effective date and provide additional notice when required. We will request consent before using information in a materially new way when the law requires it.
