Privacy Policy
Effective Date: July 21, 2026
Actually is a video-first dating app. You answer short audio prompts with 15-second selfie videos, browse other people's videos, and connect with matches. Dating data can be deeply personal, so this policy explains what we collect, how we use and disclose it, how long we keep it, and the choices available to you.
1. Who We Are and Where This Policy Applies
Actually is operated by Actually Mobile Software, LLC, a Montana limited liability company ("Actually," "we," "us," or "our"), located at 3772 Last Best Pl, Missoula, MT 59808. This policy covers the Actually mobile app and its account and sign-in experiences. Actually is initially offered only in the United States.
For privacy questions or requests, email admin@actually.dating. Washington and Nevada residents should also review our Consumer Health Data Privacy Notice.
2. Information We Collect
Account and identity information
- Phone number — your sign-in credential. We verify it with a one-time passcode sent by SMS. Our identity provider, Microsoft Azure AD B2C, maintains the phone number; our main app database stores the identity-provider account identifier used to connect your login to your profile.
- Recovery email — optional, if you add one to help recover your account.
- Name and date of birth — used to create your profile, show your age, and confirm that you are at least 18.
Profile information and content
- Profile photo and 15-second prompt videos, including your image, voice, and the content of your answers.
- About-you details you choose to provide, such as a bio, gender, job, school, education, whether you have or want children, previous marriage, and alcohol, smoking, and cannabis use.
- Sensitive details you choose to provide, such as religion and denomination, political leaning, ethnicity, and information that may reveal or imply sexual orientation. Ethnicity may be used for matching preferences but is not displayed on your profile.
- Matching preferences, including age range, distance, gender, other preferred traits, and which preferences you mark as dealbreakers.
Location
With your permission, the app reads your device location to determine your general area. Your GPS coordinates are converted on your device into a postal (ZIP) code. We receive and store the ZIP code, not the GPS coordinates, and use it to show a general area and estimate distances between members. Your device's operating system may process location information when providing this permission and service.
Activity and communications
- Likes, passes, matches, per-video likes, and prompts you skip.
- Messages you exchange with matches. Messages are transmitted over an encrypted HTTPS connection and stored on our servers, but they are not end-to-end encrypted. We may access message content to deliver the service, investigate reports, enforce our Terms, and protect members.
- Reports and blocks, including the reason or other information you submit with a report.
Purchases
If you buy Premium, Apple or Google processes the payment. We do not receive your card or bank-account details. We receive and store purchase receipts, transaction identifiers, product information, and subscription status so we can activate and verify Premium and prevent misuse.
Device and technical information
- Push-notification token so we can send match, message, and service notifications. You can turn notifications off in device settings.
- Basic technical and diagnostic information needed to secure, operate, and troubleshoot the service, such as server requests, timestamps, error records, and limited device or network information included in system logs.
We do not currently use third-party analytics, advertising, or cross-app tracking SDKs, and we do not track you across other companies' apps or websites. If this changes, we will update this policy and provide any choices required by law before using the new technology.
3. Where Information Comes From
We collect information directly from you, automatically from your device and your use of Actually, from other members when they interact with or report your account, and from service providers such as Apple and Google when they confirm a purchase or subscription status.
4. Device Permissions
The app asks before using the following device features:
| Permission | Why |
|---|---|
| Camera | Record prompt videos and take a profile photo. |
| Microphone | Record audio in prompt videos. |
| Photo library | Choose an existing photo for your profile. |
| Location while using the app | Determine your general area, which is converted to a ZIP code on your device. |
| Notifications | Alert you to matches, messages, and important service information. |
You can grant or revoke permissions in device settings. A feature may not work without its related permission.
5. Sensitive Information
Dating profiles and conversations may include sensitive personal information. Religion, political views, ethnicity, sexual orientation, messages, and some lifestyle details can receive special legal protection. Providing optional profile fields is voluntary. We use these details only to provide the profile, matching, safety, and other services you request; we do not use them for targeted advertising or to make unrelated health or other sensitive inferences. Where applicable law requires consent, you consent by choosing to provide the information after receiving the relevant notice. You can withdraw that consent for future processing by removing the information, changing the related preference, or deleting your account.
6. How We Use Information
- Create, authenticate, maintain, and support your account.
- Build your profile and show it to potential matches.
- Provide matching, distance estimates, the video feed, messages, blocks, and reports.
- Send notifications you have enabled.
- Process, verify, and administer Premium subscriptions.
- Prevent, detect, investigate, and address fraud, spam, abuse, safety incidents, and violations of our Terms.
- Secure, maintain, troubleshoot, and improve the app and our systems.
- Comply with law, respond to lawful requests, and establish, exercise, or defend legal claims.
7. How We Disclose Information
We do not sell personal information. We do not disclose it for cross-context behavioral or targeted advertising. We may disclose information as follows:
- Other members. Profile information and content are visible to members to whom we show your profile. Matches can see the messages you send them. Information you voluntarily include in profile content may be copied or shared by recipients outside Actually, so do not post anything you would not want another person to save.
- Microsoft Azure. Azure provides identity, cloud hosting, database, storage, and related infrastructure for profiles, photos, videos, messages, and other service data. Microsoft Graph is used in the account-deletion process.
- Mobile carriers. Carriers deliver one-time SMS passcodes.
- Apple and Google. They provide app distribution, in-app purchases, subscription confirmation, and push-notification delivery.
- Legal and safety disclosures. We may disclose information when reasonably necessary to comply with law or valid legal process; investigate or prevent fraud, abuse, or illegal activity; protect a person's safety, rights, or property; or enforce our Terms.
- Business transactions. Information may be reviewed or transferred in connection with financing, due diligence, a merger, acquisition, reorganization, bankruptcy, or sale of all or part of the business, subject to appropriate confidentiality and legal protections.
- With your direction or consent. We may disclose information when you ask us to or separately consent.
Our service providers may process information only to perform services for us or as otherwise permitted by contract and law. Information is primarily handled in the United States, although a provider may process it from another location subject to its contractual safeguards.
8. How Long We Keep Information
We keep information only for as long as reasonably necessary for the purposes described above:
- Profile information, photos, videos, messages, matches, and active-account records are generally kept while your account is active.
- A pass ordinarily affects your feed for about 7 days. The underlying record may remain in our system while your account is active so the service can operate consistently.
- Blocks and reports are kept while needed to enforce the block, review the report, protect members, and maintain moderation records.
- When you delete your account, your profile is removed from member view and deletion from active systems normally completes within 30 days. Residual copies may remain in routine backups until they are overwritten, ordinarily within 90 days.
- We may retain limited transaction, consent, safety, fraud-prevention, support, and legal records after account deletion. Transaction and tax-related records may be kept for up to 7 years; records needed to enforce a ban or address a serious safety matter may be kept for up to 5 years or longer when a legal hold, law-enforcement request, or ongoing claim requires it.
We may retain deidentified information that cannot reasonably be linked to you. Actual periods may be shorter when information is no longer needed, and a legal obligation or preservation request may require a longer period.
9. Deleting Your Account
You can delete your account from Settings in the app or request deletion by emailing admin@actually.dating. Account deletion removes your profile from the service and begins deletion of your profile information, media, likes, passes, matches, messages, purchase-entitlement records, and sign-in account from active systems, subject to the limited retention described above. Deleting Actually from your device does not delete your account and does not cancel a store-billed subscription.
10. Your Privacy Rights and Choices
Depending on your state, you may have the right to confirm whether we process your personal information; access, correct, delete, or obtain a portable copy of it; withdraw consent; appeal our denial of a request; and opt out of certain sales, targeted advertising, or profiling. We do not sell personal information or use it for targeted advertising, so there is no sale or targeted-advertising opt-out needed for our current practices.
You can edit many details in the app, manage permissions and notifications in device settings, and delete your account in Settings. For any other request, email admin@actually.dating and describe the right you want to exercise. You may appeal a denied request by replying to our decision and writing "Privacy Appeal" in the subject line. Where allowed, an authorized agent may submit a request for you, but we may require proof of authority and verification directly from you. We may request information reasonably needed to verify your identity and protect your account. We will not discriminate against you for exercising a privacy right.
California residents: we do not sell or share personal information as those terms are defined by California law, and we use sensitive personal information only for the limited purposes described in this policy. Washington and Nevada residents: please see our Consumer Health Data Privacy Notice for additional information and rights.
11. Age Requirement
Actually is only for adults 18 and older. We do not knowingly allow anyone under 18 to create an account or knowingly collect personal information from anyone under 18. If we learn that an account belongs to someone under 18, we will remove it.
12. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect your information, including encryption in transit and access controls. No transmission or storage method is completely secure, and we cannot guarantee absolute security.
13. Changes to This Policy
We may update this policy as the service or law changes. If a change is material, we will update the effective date and provide additional notice when required. We will request consent before using information in a materially new way when the law requires it.
